  1. Your honour, now is not the time to be "raising concerns", we've complied with the motions given to us - if Mr. Castillo wants to dispute the evidence that his own attorney demanded that we submit, he needs to do that during trial.
  2. How the department's administrative leave policy aligns with the distinction between administrative leave and disciplinary actions outlined in the department's Manual of Policy and Procedure (MPP) Section 3-01/010.10. Administrative leave, your honour, is a type of leave in which the employee retains their full pay and benefits. The Sheriff's Department does not differ from this definition. The closest relevant disciplinary action from the MPP is a suspension, which is where an employee is forbidden from conducting their duties for a period of time. Mr. Castillo was not in fact forbidden from conducting his duties by the Department, but was instead placed on leave. Mr. Castillo was told that he needed to surrender his firearm, and this is why the administrative leave was enacted. Mr. Castillo was more than welcome to contact the Internal Affairs Bureau to see what duties he could perform that do not require the use of a firearm, but instead opted to ride out his paid leave without asking if such a thing could be arranged. The specific procedures and timelines in place for administrative leave, particularly after use-of-force incidents. Administrative leave generally lasts until a use of force investigation is concluded, however may be concluded earlier based on a number of factors as and when department management determines that administrative leave is no longer necessary. In this case, Mr. Castillo was afforded the courtesy of concluding the administrative leave early while an executive use of force review committee was set up, as a commitment to Mr. Castillo that the Sheriff's Department does not treat its employees unfairly. The procedure for placing a person on administrative leave has been explained already. The Internal Affairs Bureau may place any employee on administrative leave over use of force incidents. This is entirely discretionary and at the will of department management and the Internal Affairs Bureau based on whether or not the investigating officer feels there is a necessity. This could be for reasons such as to protect the affected deputy from public opinion or the opinion of fellow deputies, to gather evidence or guarantee that evidence cannot be unintentionally disturbed, and to prepare for an upcoming administrative investigation where it is required that the affected deputy does not have access to a firearm. In this case, Mr. Castillo was placed on administrative leave in preparation for an upcoming administrative investigation, and due to the nature - use of force by a government officer - it was deemed necessary that Mr. Castillo not retain his service firearm so that the factors of the incident could be preserved as best they could in order to guarantee a fair and undisturbed investigation into an incident where a citizen of the state was shot by a government officer. Whether Sergeant Castillo's rights were violated during the initial field interview in regards of asking for legal assistance. Forgive me your honour, but as I have already explained, the field interview was not incriminating and had no possibility of being incriminating, hence Mr. Castillo not being given a Garrity warning or a Miranda warning. Mr. Castillo had no right to legal assistance during the field interview because he was not under threat of any legal repercussions, or any departmental action based on Mr. Castillo's performance, and thus neither Miranda nor Garrity applied. And forgive me your honour, but should the Plaintiff not be asking these questions in trial? @almightybounter @Levy
  3. Your honour, we have fulfilled the Order Granting Motion to Compel in Part. Addressing the justification for placing Sergeant Castillo on administrative leave. Your honour, the justification for placing Stefan Castillo on Administrative Leave was the fact he discharged his firearm in the line of duty. While not strictly enforced, it is common practice in every department in the United States to place a peace officer on administrative leave when they discharge their firearm, especially if they strike another person. This is not a disciplinary measure, and Deputy Castillo was not deprived of his pay or departmental benefit eligibility during the duration of his administrative leave. As per the Department's Manual of Policy and Procedure, which Mr. Castillo is thoroughly acquainted with as an experienced peace officer, discipline is defined as the following: Mr. Castillo was not disciplined as per the Department's definitions. Further, the Internal Affairs Bureau reserves the right to place an individual on administrative leave for any investigation when it comes to use of force. The Department member was placed on it due to the fact no clear facts were presented to us, therefore we had to separate the Department member from their duty weapon and service until we figured out what happened. This was a peace officer-involved shooting in which a civilian was struck by a bullet, fired from a government-issued firearm. This is the kind of thing that demands concentration and effort to make sure all the facts are correct, and to protect Mr. Castillo from the court of public opinion. Concerning the specific policy or regulation violated by Sergeant Castillo, if any. Mr. Castillo was not determined to have violated any specific policy or regulation before the administrative leave was enacted. Administrative leave is not punitive or disciplinary in nature so this would not have happened even if Mr. Castillo had been determined to have violated a specific policy or regulation. Tell me - administrative leave includes full pay and benefits. Would a person being disciplined be awarded their full pay and benefits? Concerning the details of the ongoing investigation, considering the REDACTED materials already provided. "The details" have all been forwarded to the court and to Plaintiff as per the motion to compel that was accepted in part. The Sheriff's Department is prepared to talk about anything included in that material more specifically if asked. On whether or not the administrative leave constitutes retaliation for Sergeant Castillo asserting his rights during the field interview. The Use of Force field interview is not a disciplinary interview and is merely a background investigation into why something happened that is then used to determine if an internal investigation is even necessary. Use of Force field interviews are not part of an administrative or criminal investigation against a peace officer that is being interviewed, and is instead a tool to determine the narrative of the use of force. Mr. Castillo was not afforded a Garrity warning during this use of force field interview because Mr. Castillo was at no point under threat of incrimination as a result of this field interview. The process would have been for use of force investigators to interview Mr. Castillo, paint a background picture, and then either recommend or not recommend that an internal investigation be opened. Mr. Castillo's refusal to assist law enforcement in a lawful enquiry into the use of force by a government officer against a citizen of this state prompted the internal investigation to be commissioned, and as previously explained, the Internal Affairs Bureau may place an individual on administrative leave for any active investigation when it comes to use of force. Mr. Castillo incorrectly assumed that the fact-gathering, background-painting field interview was an administrative investigation against Mr. Castillo, and refused to cooperate with a lawful law enforcement investigation, and as such an administrative investigation was commissioned. After all, your honour, what active peace officer actively tries to block a lawful investigation? Especially based on rights that he is not even afforded, such as the Garrity rights, because it was not an administrative investigation on Mr. Castillo and there was no threat of Mr. Castillo being incriminated through this use of force field interview. In Mr. Castillo's follow up interview, where he was afforded his Garrity rights because there was now an administrative investigation on Mr. Castillo, it is made clear that investigators are still just trying to paint that background picture, that narrative on what actually happened. I want to reiterate this. Mr. Castillo himself answered that the use of force field interview at the hospital, and I'm quoting direct from the transcript here, "this wasn't during any official investigation." Mr. Castillo was fully aware that there was no official investigation underway, and thus knew that he was not under threat of incrimination, and thus the Garrity rights did not apply during the use of force investigation. Mr. Castillo still intentionally blocked a lawful investigation into the use of force by a government officer against a citizen of the state. This is why Mr. Castillo was placed on administrative leave, for the now active administrative investigation into Mr. Castillo's use of force, not as retaliation for him refusing to cooperate with a use of force interview.
  4. Your honour, more "we believe" and no "we have evidence that suggests..." talk here. The plaintiff's motion to compel is not based on any kind of fact, but mere belief, and should be rejected.
  5. Your honour, mere "belief" is not enough to compel a private - no, confidential - file of an active investigation on a member of the department that is also currently actively serving. To compel this file would place the administrative investigation's integrity in jeopardy at a time when it needs to be as fair, un-rushed and thorough as possible to make sure that plaintiff Stefan Castillo is treated fairly and equally under the law. To intentionally disrupt Mr. Castillo's investigation now could be detrimental to Mr. Castillo. Further, can the plaintiff actually provide anything more than "we believe" that what they are seeking is in this case file? Otherwise what stops me from requesting Mr. Castillo's bank statements on the off-chance that there might be something related to his performance as a peace officer? @almightybounter

  8. Hi all, Just want to say a massive thank you to the community and the staff members who are actively working in the background to make Los Santos Roleplay a great server to play. There has been a lot of teams working in the background to provide Los Santos Roleplay with the best roleplay possible and listening to our community with any changes that are needed. Let's not beat around the bush here. There is an obvious elephant in this room. What happened at Wonderland 2024? Also (sadly) known as the "Alien Event" We rushed it, plainly put. The event was originally scheduled for later in the month, with a much better marketing strategy, but due to other constraints - namely that we haven't had a big event since the SA-MP relaunch - it was pushed forward and what would have been a couple of months turned into a couple of weeks. This is no fault of the event organisers, @ROZE and @Xanakin, but is a consequence of Management deciding last minute that we need a big event ASAP to offset the fact we haven't had one yet without putting much thought into how the months of preparation could be condensed into two weeks in a way that doesn't over-saturate players. We've heard your feedback and we realise now that we truly did over-saturate you guys with the event. The general consensus within the staff team around the festival is that if you roleplay in an area in East LS that can see the festival, why not simply roleplay around it? People in and around Ganton can see the festival clear as day, so why not use this opportunity to do something different? Intercept the new civilian traffic in Playa de Seville, move your roleplay indoors to hide your shady dealings from the increased foot traffic, go to the festival and push pills, maybe even write a letter to the Mayor complaining about the noise? Unfortunately we failed to see that not everybody wants to roleplay the festival existing, and for people in the Killeen Mob turf in Playa de Seville, it was really hard to ignore. I only really realised this myself when I stood at Ganton 24/7 and I could see the giant UFO and red spotlights beaming out from behind it. I see why it's distracting when you want to ignore it. That's why we've reduced the render distance so you need to be on East Beach to see it, and we moved it up by Atlantic Avenue, so you cannot see it from Playa de Seville. The marketing was rushed. Again this is no fault of the organisers but a consequence of Management demanding that they pack months' worth of news articles, interviews, social media posts and announcements into two weeks. This means that, unfortunately, we did things like create UFO objects in the county which - originally - were intended to be very clearly movie props, with 3D text labels, construction equipment, etc., most of that was left out and people's imagination went wild with the fact a UFO has just appeared. We even saw the LSSD send out a bomb squad to make sure it was safe, which shouldn't have happened in any real, obvious-movie-prop scenario. What this rushed marketing caused is a cascade of people roleplaying actual aliens. We tried our best from the start to tell people they were just movie props and smoke machines, not an actual UFO crash, but it seemed to be too little, too late. We should have advertised Wonderland first, and then slowly introduced the theme, before any movie props were spawned. This turned into rumours, SAN ran away with an actual alien invasion conspiracy, and people started roleplaying things that are not acceptable on our server. We should have made it clear from the start it was a festival and not allow anybody to run away with the idea of an alien invasion being roleplayed. After all, LS-RP was built on its realistic portrayal of gang life, and dare I say that is the reason LS-RP exists. Police factions exist, pretty much, to mirror gangs. After all, legal civilian roleplayers rarely interact with police, so why would we need a police faction without the illegal roleplayers? And now the controversial UFO text. We repeatedly said, especially to illegal and gang roleplayers, "don't want to go to Wonderland? Just ignore it". You can't ignore it when we put text up in the middle of your screen saying "have you seen the UFO?". That was a clear and obvious mistake, and while it was only ~3 seconds that it was on the screen, it immediately pulled everyone out of their roleplay and, understandably, upset a lot of people. You can't ignore it when you stand at Ganton 24/7 and look east, and half your screen is filled with a giant UFO and red beams of light. We told you to ignore it, and made it impossible to do so for half the map. I think something we did do right is scrap the implementation of the alien skin. Although only 1 person was going to use it, there was a lot of upset that the skin doesn't look like a costume and that it might encourage people to roleplay seeing an actual alien, so we scrapped it. The Faction Team has done a great job of forwarding complaints around Wonderland 2024 from the illegal roleplayers of the server. Please keep directing your feedback to them and they will continue gathering it and directing it to us. After all, the Illegal Faction Team are part of the same staff team that I am part of, that the Head of Legal Factions is part of, that the Events Team is part of - we are one team and they do a good job of keeping illegal roleplayers' concerns heard. We can't improve for next time if you don't tell us how to improve, we (sadly) are not all-knowing, although sometimes it seems we act like we are, and that's something we're working on. But as much negativity as we got, we had over 100 people at Wonderland on Saturday enjoying the event, giving positive feedback, and generally just having fun! Wonderland is a place where people can be a little sillier, with their costumes, dance animations, and music. We try our best to keep this contained to Wonderland, however, so people outside of Wonderland aren't exposed to the silliness! Check out this video by Big Tank, one of our long-standing illegal roleplayers! Anyway. You want to ignore Wonderland 2024, I'm not going to bore you anymore with it. The event is still running for the rest of the weekend, albeit further north up East Beach and not directly outside Playa de Seville. Now onto the rest of the community update. Lastly, we are contemplating organizing a Los Santos Grand Prix event on the Rage server, utilizing the available F1 cars. To ensure a successful turnout, we plan to implement an out-of-character (OOC) registration process before finalizing the track mapping. Your honour, we would like to submit three documents to the court as evidence: Mr. Cohen's licence application, and the current PF licence regulations. These will be referred to as exhibits A and B by the defence respectively. Does Mr. Cohen remember what he wrote and signed on his licence application, on defence exhibit A, your honour? Allow me to read it out: "All the firearms listed above will be kept inside of a safe at the owner's property when not in use." Surely Mr. Cohen, an upstanding member of our city, was telling the truth on his licence application, your honour? Then why was his firearm in his glove compartment? No matter, your honour. Everybody makes mistakes, or they forget what they said, or circumstances change. Take a look at exhibit B your honour - it specifically says right there that the glove compartment is not considered a valid place to transport your weapon. "The term "locked container" means a secure container which is fully enclosed ... but does not include the utility or glove compartment." Your honour, this is a simple case. Arguably a waste of the court's time, your honour. Mr. Cohen lied on his licence application and then violated the PF regulations - such a violation is exactly what he was charged with. Any license owner who is intoxicated; being tested above 0.08 BAC (Blood-Alcohol-Levels). Must not be in possession of any firearms other than the ones they applied for. Must not allow others to use their firearm under any non-exigent circumstances. Must not be under the influence of any substance (e.g. pharmaceutical drugs or alcohol) when in possession of a firearm nor be under the influence prior to obtaining possession of a firearm. Must not remove the firearm from its storage unless required to do so. Must not remove the firearm from its locked container when transporting the firearm to a property. Must not assist peace officers with their duties using a firearm. May Open Carry their handgun, in compliance with the Open Carry Assurance and Regulation Act. Firearms being transported, where the owner only possesses a PF License and is not Open Carrying in compliance with the Open Carry Assurance and Regulation Act, must be stored in a locked container. The term "locked container" means a secure container which is fully enclosed and locked by a padlock, key lock, combination lock, or similar locking device. This includes the trunk of a motor vehicle, but does not include the utility or glove compartment. Must ensure their firearm is always cleaned, safe, and well maintained. Must immediately identify themselves as a license holder if they are detained by a peace officer and if they are at the time of detainment in possession of a firearm. When detained by a law enforcement officer, must surrender their firearm for the duration of the detainment if asked to do so, and shall have it returned when released from custody. (( Must not purchase firearms for any other person. This is a ban-worthy offense. )) (( Must not purchase firearms that are not listed on their PF application (either by buying more firearms than they stated they would or buying firearms they stated they would not buy). This is a ban-worthy offense. )) (( Must not possess more than ONE of each firearm they applied for. )) Open Carry Assurance and Regulation Act: _A PF License holder can: Open carry their firearm, and only the firearm they have applied for, in designated 'Open Carry Zones' and may only openly carry handguns. This only applies to the open carry zones and not to private property. Open carry in the entire State of San Andreas, with the exception of: The City of Los Santos. San Fierro Airport Las Venturas Airport The National Guard Airstrip Sidewalks adjacent to any property of the Los Santos County Sheriff's Department. The entire block surrounding the Los Santos County Sheriff's Department headquarters in Dillimore, in accordance with this image. Hunt in designated hunting zones around San Andreas and may open carry long guns if they are participating in an active hunt. Openly carry any firearm inside their private property and/or other people's private property, given that the property owner has given their consent. This is not limited to the 'Open Carry Zones' and is permitted throughout the entire State. Must state they are openly carrying a firearm during a traffic stop with any law enforcement officer. Must, when transporting their firearm in a vehicle, ensure that their firearm(s) are properly secured within a locked gun case, lockbox, or strapped in a holster with the safety on. Have their license suspended or revoked for violation of any regulations in this act for a specific individual in accordance with the San Andreas Penal Code (9)13. CCW / PF Violation. _A PF License holder cannot: Open carry during a state of emergency, unless the Governor of San Andreas explicitly states otherwise. Open carry firearms that are not their own and do not have the correct permit to carry. If a permit holder lacks the required permit to carry the specific type of handgun of which they are openly carrying, in either the 'Open Carry Zone' or hunting zone, they shall be dealt with in accordance with the law. Open carry a firearm within a 2000 ft radius of the San Andreas Correctional Facility or inside any government-owned buildings.

  12. Your honor, justice comes to everybody that breaks the law. A heart surgeon is not above the law, and neither is Dr. Cohen. The defense will demonstrate fairly simply how Dr. Cohen violated the law and was held to account for it. We do not live in a society where certain people can commit crimes where others cannot. We should not live in such a society; such a society would break down. We will demonstrate to the court that Dr. Cohen was unlawful in his usage of his license and we hope that the plaintiff understands exactly why everybody must be held to account, even our city's doctors, when they break the law.
