Hospital Structure Board of Directors (( NPC )) The Board of Directors is responsible for providing strategic oversight and governance to the hospital's operations and policies. They make crucial decisions concerning financial matters, quality of care, and overall direction of the institution. Additionally, they appoint and evaluate the hospital's chief medical officers to ensure efficient and effective management. (( Because Mount Zonah falls under the FD only on an OOC-basis, the Fire Chief can stand in place of the Board of Directors, giving an in-character reason for changes urged by the Fire Chief. )) Board of Governors (( NPC )) The Board of Governors has become the primary fundraising and leadership development group at Mount Zonah. Their mission is to support Mount Zonah's foremost clinical programs, biomedical research, and community outreach by providing financial resources, educational experiences, and volunteer opportunities. Human Resources (( Partially NPC )) Human Resources professionals handle a wide range of functions, including recruitment, hiring, onboarding, physician/nurse training and development, performance management, benefits administration, employee relations, and ensuring compliance with laws and regulations. Their primary goal is to support the medical center's employees, foster a positive work environment, and align HR practices with the overall strategic objectives of the company. (( HR is comprised of the Chief Medical Officers and Hospital Supervisors. )) Chief Medical Officers Chief of Medicine Deputy Chief of Medicine The Chief Medical Officers serve as the clinical leadership of Mount Zonah Medical Center and are responsible for setting medical standards, protocols, and policies. They play a crucial role in ensuring the delivery of high-quality patient care and clinical outcomes. CMOs also collaborate with the hospital's administrative leadership to align medical practices with the organization's strategic goals and maintain the highest standards of medical excellence. They are also charged with maintaining the hospital's competitive residency program. The current Chief of Medicine is Dr. David A. Reynolds, MD, FACS, FACC. Hospital Supervisors Attending Physician Hospital Supervisors are experienced medical doctors who are responsible for the direct care of patients within Mount Zonah. They chair specialty teams, supervise residents and medical students, and make critical decisions regarding patient diagnosis, treatment plans, and overall management. Attending Physicians play a pivotal role in ensuring that patients receive the best possible medical care and are actively involved in providing guidance and expertise to the healthcare team. Hospital House Staff Fellow Chief Resident Resident Intern Hospital House Staff are doctors who play a crucial role in providing direct patient care under the supervision of attending physicians and the CMOs. House Staff members actively involved in patient assessments, treatment planning, and medical procedures, all while gaining valuable hands-on experience and furthering their medical education. Nursing Staff (( All NPC )) Advanced Practice Registered Nurse (APRN) Registered Nurse (RN) Licensed Practical Nurse (LPN) Certified Nursing Assistant (CNA) Nursing Staff provide essential patient care and support within our facility. They play a critical role in maintaining patients' well-being by administering medications, monitoring vital signs, assisting with daily activities, and providing emotional support. Nursing Staff also collaborate with other healthcare professionals to ensure effective communication and coordination of patient care, contributing significantly to the overall healthcare experience and patient outcomes. Our Residency Program Mount Zonah's accredited residency program trains physicians in their chosen fields, from pediatrics, primary care and internal medicine to anesthesiology, pharmacy and nursing. Our programs are highly competitive and allow our residents to enhance their skills in one of the top hospitals in the country. Our programs are led by some of the nation's best physician-educators. We are at the forefront of medicine and innovation, translating groundbreaking discoveries into successful treatments with global impact. Resident Physicians, upon successful completion of medical school, join our staff as Interns (PGY-1 of Residency). They are responsible for working under the supervision of other physicians, as well as performing and recording basic diagnostic and treatment procedures. Interns conduct rounds with each specialty that the Medical Center offers before choosing a specialty of their own. Our Fellowship Program With an emphasis on collaborative, multidisciplinary patient care, Mount Zonah offers fellowship experiences across an array of programs. Fellows work shoulder to shoulder with some of the nation’s best physician-educators and have full access to top-of-the-line resources and facilities. Currently, Mount Zonah Medical Center offers ten fellowship programs. Each Fellowship may last from one to three years. The fellowship selected must generally align with the specialty chosen during residency. Cardiothoracic Surgery focuses on the surgical treatment of organs in the chest, generally the heart and lungs. Upon completion of this fellowship, the physician becomes a Fellow of the American College of Cardiology (FACC). Clinical Neurophysiology focuses on the clinical and surgical treatment of the nervous system, generally the brain, spine, and nerves. Upon completion of this fellowship, the physician becomes a Fellow of the American Academy of Neurology (FAAN). Clinical Psychiatry focuses on the clinical treatment of mental disorders. Upon completion of this fellowship, the physician becomes a Fellow of the American Psychiatric Association (FAPA). Critical Care Medicine focuses on the treatment of critical illness, providing life support, invasive monitoring, resuscitation, and end-of-life care. Upon completion of this fellowship, the physician becomes a Fellow of the the American College of Critical Care Medicine (FCCM). Emergency Medicine focuses on illnesses and injuries that require immediate treatment, typically in the Emergency Room. Upon completion of this fellowship, the physician becomes a Fellow of the American College of Emergency Physicians (FACEP). General Surgery focuses on the surgical treatment of the abdominal organs, generally the gastrointestinal system. If the physician did not become a member of the American College of Surgeons during residency, then upon completion of this fellowship, the physician becomes a Fellow of the American College of Surgeons (FACS). Medical Oncology focuses on the prevention, diagnosis, and treatment of cancer. Upon completion of this fellowship, the physician becomes a Fellow of the American Society of Clinical Oncology (FASCO). Obstetrics & Gynecology focuses on pregnancy, childbirth, and diagnosis and treatment of disorders of the female reproductive system. Upon completion of this fellowship, the physician becomes a Fellow of the American College of Obstetricians and Gynecologists (FACOG). Orthopedic Surgery focuses on the surgical treatment of musculoskeletal system, generally the bones and muscle structures. Upon completion of this fellowship, the physician becomes a Fellow of the American Academy of Orthopaedic Surgeons (FAAOS). Trauma Surgery focuses on the surgical and non-surgical, acute treatment of traumatic injuries. If the physician did not become a member of the American College of Surgeons during residency, then upon completion of this fellowship, the physician becomes a Fellow of the American College of Surgeons (FACS) and is entitled to become a member of the ACS Committee on Trauma (ACS COT); however, COT will not be appended to the physican's title, only FACS. (Needs to have the proper faction permission to do so.) /uninvite [ ID ] — Through this command you can remove a player to the faction. (Restricted to legal factions.) /fixsiren — Through this command you can fix a siren/bullhorn that is broken on your vehicle. /dutytime [ Faction ID ] [ Month in # ] — Through this command you can see your faction members' activity through on the month. (Needs to have the proper faction permission to do so.) [ PD / SD / GOV ] /roadblocks — Through this command you can a list of the current deployed roadblock scenes. [ PD / SD / GOV ] /disbandscene [ Scene ]— Through this command you disband an entire roadblock scene, which will remove all the roadblocks spawned in said scene. [ PD / SD / GOV ] /togroadblock — Through this command you can toggle the blue /roadblock messages on or off. This can also be toggled in /settings. [ PD / SD / GOV ] /selectroadblock — Through this command you can target the closest roadblock and see information about it. If you click on the item, you get a list of actions; Info, Move, Duplicate and Disband. LSPD / LSSD Commands /duty (or) /duty [ Callsign ] [ Auto ] — Self explanatory. Through the command /duty [ Callsign ] [ Auto ], it allows you to go on duty with the last loadout you used. /towcars [ f/c (faction or company) ] [ Faction ID / Company ID ] — Through this command you can tow all the faction or company vehicles you have access to. /mdc — Through this command you can open up the MDC (Mobile Data Computer) User Interface. /meg — Through this command you can use the megaphone. /hq [ Text ] [ 1, 2 or 3 or none ] — Through this command you can broadcast a priority message in blue. By adding 1, 2 or 3 at the end of the message, it beeps the same amount as the number. If no number is added, there won't be any beeps. /uniform — Through this command you can select the uniform you want to use. /saveuniform [ patrol, patrol2, patrol3, patrol4, tac, tac2, tac3, plain, plain2, plain3, special ] — Through this command you can save your uniform. /handcuff [ Target ] — Through this command you can handcuff another individual. /unhandcuff [ Target ] — Through this command you can remove the handcuffs of an individual that has been put in handcuffs. /ziptie [ Target ] — Through this command you can place zipties on the wrists of another individual. /ticketvehicle [ Vehicle ID ] [ Ticket Item ID ] — Through this command you can place a printed out ticket on a vehicle. /togfac — Through this command you can toggle the faction chat on/off. /nofac — Through this command you can turn off/on the faction chat for all members. (Your rank needs to have the permission set to do so.) /confiscate [ Target ] [ Item Index or Name ] — Through this command you can confiscate items from another person. /spikestrip | /ss [ Type (0, 1, 2 or 3) ] — Through this command you can place down spike strips. If you just do /spikestrip, it spawns the default type, which is 0. /roadblock [ Scene ] [ Model ] — Through this command you can place many different kind of roadblocks. If you just do /roadblock, a menu will pop up there you can create a new scene and see a list of all active scenes. /disband — Through this command you can disband the nearest roadblock or spike strip that has been placed. [ PD Exclusive ] /swat — Through this command you can go on S.W.A.T. duty. [ SD Exclusive ] /swt — Through this command you can go on S.W.A.T. duty. LSFD Commands /dep ( or /deplow ) [ Text ] — Used to communicate with fellow government agencies. Broadcasts to all factions by default. See /setdep. /duty — Used to set yourself as on duty through the script. Gives access to certain faction commands. /f [ Text ] — Used to type in faction chat. /factionon — Used to showcase which faction members are online. Faction members are color coded based on duty status: faction color represents on duty, grey represents off duty. /hq [ Text ] — Used to broadcast pagers and important announcements to members. /nofac — Disables faction chat for all members. /offduty — Used to set yourself as off duty through the script. Revokes access to certain faction commands. Must be on duty through the script to use. /rescue [ ID ] — Used to revive a player out of the brutally wounded system once roleplay has been performed. /heal [ ID ] — Used to heal a player once roleplay has been performed. /v setpark — Alters the position of a factionized vehicle upon spawn. /putinambu [ ID ] — Used to place a player in the back of an Ambulance. Must be used inside of an Ambulance or helicopter. /setdep [ All / Police / Sheriff / Fire / City ] — Used to set which agency you will communicate with when using the /dep command. /togfac — Disables faction chat. /towcars — Tows faction vehicles. The indefinite seizure Tungsten mentioned would be a permanent impound, essentially. But without script support it'd require Senior Admin+ I think to park it somewhere - maybe an underground parking lot can be set to a vw and a faction prop so nobody can access the garage and the vehicles are kept there. So the owner can't just go take it out of impound or something2 points

I believe it has something to do with mentality of people. If the mentality can't be changed, nothing will change no matter how much you punish people. I see a lot of people, basing their 'shooting roleplay' on real life scenarios, especially USA. People flock to the media and take away only the extremity cases - someone punches another person and he gets shot. Quite frankly, a lot of people base their roleplay by that, but it just doesn't make sense. If you're so weak mentally in real life that you can't take an insult in-game, you shouldn't play the game. As of now, some insults or brawls are like green lights for people just to hunt down others and DM. The aspect of possibility to roleplay some conflict is getting demolished by said mentality. I am speaking from illegal faction perspective - believe me, it is hectic as hell, not a lot of space to roleplay a conflict between factions, because majority of the time, you'll probably get shot instantly if you'll try to initiate some kind of brawl (I'm all for punching each other and roleplaying that than instantly go for AKs and wiping all of your opponents). If we Force CK characters of DMers, they'll just create another character and grind out the levels so either they can rob, shoot or buy PF - that's the reality of the system. With prisons, people will automatically create another character for their endeavors as from the start they aren't here to roleplay. That would be mine cookie in this conversation.2 points

I wanted to give some transparency into what is going on with the Courts faction. I have recently taken over as Chief Justice, as we had a vacancy and I have run it before on SAMP. We are naturally a very small faction numbers wise, but can play a role for the legal side for those that choose to pursue it. We would love to answer any questions and get some feedback from the community on what you want to see, so we can try to work what we can. Some info: - We currently have 9 people in the role of Judge. This includes an alt each from the highest ranks (myself as Rank 1 and Kotwica as Rank 2) - We just recently appointed a District Attorney and a Chief Deputy District Attorney - We opened up applications for the Public Defender's Office & allowing those applying to test for the State Bar license during the application process - We handle the warrants for PD/SD on our forum (on SAMP we had to go to each forum to do warrants) We are working on furnishing our Courthouse,, which we will share the 'HOJ' building with LSSD. That building will host the Courts & Necessary rooms for it as well as the SD parts that are using it. We are also working on furnishing the 'Davis City Hall' into a building which will host our offices for the Public Defenders and DA's offices (on separate floors). I'm planning to post an article IC when those buildings' exterior mapping gets done so we can launch the names officially. Some things we have in the works that I can share (and hopefully more soon as we develop them behind the scenes): - Establishing some sort of IG court case schedule where people can come be heard - The DA's office is aiming to work alongside PD/SD detectives for casefiles2 points

Perhaps the way to solve the problem of habitual addicts to shooting would be an OOC method for admins to "ban" a person from having a gun. This way they can be encouraged to explore other methods of roleplay that don't involve guns. Something like -- person tries to buy a gun on the street -- tries to pick it up -- error message shows up: (( You are currently under an OOC weapons restriction and cannot pick up this weapon. )) To this point, sometimes the best way to train someone in a preferred method is Negative Conditioning. If players figure out that drawing down on cops when surrounded leads to losing their character, they might do it once or twice before they eventually rethink how they approach the situation. People will bitch and moan for a while until they figure out how things work and roleplay will improve.1 point

I believe the quality control should be divided by the Staff and faction leaders. I'll throw a rock in the gang roleplay. As of now, street gang roleplayers are saying they need more modded neighbourhoods for their roleplay, because they do not fit in this map (The map is way bigger than San Andreas, but somehow we do not fit? Questionable). I see this as searching for a problem, where there isn't one. At this moment, we have around 11 street gangs, ranging both between african-americans and mexicans (talking more about the South Los Santos). The sole reason, why gangs do not fit is because they are creating them left and right. Let's be fair here, we have only 2 or 3 good gang factions, why not join them, learn the ropes and roleplay with that. If we would make just 4 or 5 good quality, big gang factions, the turf of these gangs could expand, more cliques of these factions could be created while under one umbrella. Problem solved. Additionally, people could learn from the more experienced roleplayers and become them in the future, hence the 'shootout mentality' could be demolished from the inside. For those, who'll come and say, 'me and my friends wanted to roleplay together so we created a gang' - that's an excuse. Join an already existing gang, roleplay with them, develop and if the faction becomes big, you can create your own clique and roleplay with your friends. For now, it seems like people have DM mentality and are creating gangs to hide their true intentions. If you want to roleplay, for example, in Forum Drive - join the gang that exists there and don't create new faction right besides the existing one. They are DMers? Relocate and join a better faction - your roleplay shouldn't be limited because you dreadfully want to be in one place of the map, this only shows that you don't want to roleplay, but perhaps you're seeking a way to conflict with others as you'll be creating rival gang right besides their front step (which doesn't look realistic, a gang expanding their turf into yours - that's realistic). When it comes to weapons, I agree with the statement above, that before you sell any weapons, you should be wary to whom you're selling them. Realistically speaking, the weapons you sell to others could easily be turned against you, so selling your weapons only for profit doesn't make sense, in my opinion.1 point

Through the command /duty [ Callsign ] [ Auto ], it allows you to go on duty with the last loadout you used. /towcars [ f/c (faction or company) ] [ Faction ID / Company ID ] — Through this command you can tow all the faction or company vehicles you have access to. /mdc — Through this command you can open up the MDC (Mobile Data Computer) User Interface. /meg — Through this command you can use the megaphone. /hq [ Text ] [ 1, 2 or 3 or none ] — Through this command you can broadcast a priority message in blue. By adding 1, 2 or 3 at the end of the message, it beeps the same amount as the number. If no number is added, there won't be any beeps. /uniform — Through this command you can select the uniform you want to use. /saveuniform [ patrol, patrol2, patrol3, patrol4, tac, tac2, tac3, plain, plain2, plain3, special ] — Through this command you can save your uniform. /handcuff [ Target ] — Through this command you can handcuff another individual. /unhandcuff [ Target ] — Through this command you can remove the handcuffs of an individual that has been put in handcuffs. /ziptie [ Target ] — Through this command you can place zipties on the wrists of another individual. /ticketvehicle [ Vehicle ID ] [ Ticket Item ID ] — Through this command you can place a printed out ticket on a vehicle. /togfac — Through this command you can toggle the faction chat on/off. /nofac — Through this command you can turn off/on the faction chat for all members. (Your rank needs to have the permission set to do so.) /confiscate [ Target ] [ Item Index or Name ] — Through this command you can confiscate items from another person. /spikestrip | /ss [ Type (0, 1, 2 or 3) ] — Through this command you can place down spike strips. If you just do /spikestrip, it spawns the default type, which is 0. /roadblock [ Scene ] [ Model ] — Through this command you can place many different kind of roadblocks. If you just do /roadblock, a menu will pop up there you can create a new scene and see a list of all active scenes. /disband — Through this command you can disband the nearest roadblock or spike strip that has been placed. /swat — Through this command you can go on S.W.A.T. duty. PC 029(c) states: "A judge may order the indefinite seizure of any vehicle used in the commission of the crime when it has been demonstrated that an individual is unlikely to cease committing the offense in the future and such vehicle was used in the commission of the crime." Seizure of a vehicle does not warrant that the state can then put it to auction, since no provision of law states that the State becomes the new owner. When a vehicle is seized, it remains the property of the original owner but is in the possession of law enforcement. City Council would need to pass an ordinance to this effect in order to authorize the auction of a vehicle.1 point

I think it's a chain of things that need to be done to fix the issue at hand. Make it harder to get a gun. A player shouldn't find a gun in every corner they turn. Guns should be distributed from organized crime down to gangs and gangs should push them on the street to make some profit. Getting a gun from a gang member shouldn't be a walk in the park either. Both parties should properly roleplay some fear. The gang member should evaluate who they are selling to. A plug should be a friend or someone who proved their worth. Personally I remember back in SAMP, through my MC we would push guns only to people we trusted. That would be through IC means such as... "What have they done for us" "who was the connection to them" "why should we supply them with guns" "what we get in return". Drugs is another thing. But guns, it's a serious threat. PF Licenses to be monitored closely. PF gangs should be eliminated. No one should be getting a PF license for the sake of running around killing cops/other players and just hide. We need serious moderation on that end and people should get their PF revoked or even generally banned from getting a PF if they are doing it over and over again. As in, OOC bans from PF license for DMers/known violators with malicious mindset. Roleplay Quality Control. Admins & testers need to moderate our RP Quality. No cop should be acting like a thug or act like a badass person who just came out from a police drama movie. Cops shouldn't act like Jason Statham on drug, but as regular people who don't even get paid enough for what they do. Same works for the counterpart. You do illegal activities to make money for a reason. That's to pay your rent, get your GF out for food, lifestyle, neighborhood you grew up into, adapt to a gang/group that needs you to prove loyalty. If someone falls into illegal activity for the lols, they should consider a cops vs robbers server and not LS-RP. That's my idea around it. That can only be controlled through the Staff and promoted by the playerbase which is part of the good image of this server and its legacy. For me, it's just sad to see it rot like that at such early stages.1 point

Lol I really agree with that. Personally I'd prefer 1-2 shootouts per 8-hours IG than 20 shootouts in 1 hour without any context in the RP around it. I'd really like to see some input into that from the Staff team to be honest with you.1 point

I'd like to see CKs fly with whatever system you have in mind (e.g. mine or alternatives others have suggested in the same thread). Let being a rambo have an actual danger element to it that makes people think twice. Other things too, like permanent license revokes, car confiscations, lifetime in prison, etc. Just consequences. I can kill 10 people, evade the cops, die in a shootout with cops, respawn, spend $1000 on an easily accessible gun and go right back at it. Like c'mon is this heavy rp, or are we just saying it?1 point

I fully agree on the Force CK rule which I believe will fix most of the issues when it comes to no sense shootings. I am not targeting only shootings against cops now, cause in the end of the day, cops enjoy a good shootout too. Let's not forget, that cops are passively Roleplaying here. The root of roleplay is the illegal & civilian scene, who have to create the scenarios. Cops usually are passively involved in those scenes and can provide good RP from their end. But they're usually the receiving end of RP, which in my head, gives the other side the upper hand on how the scenario will escalate. This is also the magic in RP. Furthermore, I believe that any poor based shooting which results into the aggressor's death, should lead to a Force CK. Cause apparently they do it to die or for the luls. If it's for the luls, I think Force CK will make them reconsider if this is a Medium → Heavy Roleplay Server or a FiveM RPG (RP) server. Let's say, even if an illegal character, ends up in a silly situation where they confront 5-6 gang members and he decides to pull a gun instead of giving up; they should be forced to CK due to the situation they brought to themselves - it's pretty much suicide to avoid any repercussions. Same should work for silly moves by cops. If a cop intentionally ends up in a gang neighborhood, outnumbered and decides to just pull a gun and act like a hero - in case they die, they should receive a force CK. If they survive, they should face serious IC consequences. I've said it before in SD forums and I'll say it again. This is indeed a game. A roleplay and immersive environment. But still a game. We should promote creativity, good roleplay and fair chances but up to an extent so we can keep a balance between immersion & fun.1 point

I think the best type of roleplay personally is RP based on light humour, comedy and not taking things too seriously, where both participants or all parties gain an experience from it, a good experience. A lot of RP has a focus transacationally usually with one party taking a loss and another taking a win and there is way too much emphasis on that. Organic genuine RP that both parties walk away having gained a pleasurable and rememberable experience with a bunch of laughter thrown in to the mix.1 point

Unofficial Guide to Justice and Law in San Andreas ••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••• This guide is an unofficial explanation of how the Justice System works on LS:RP. This guide can help you determine what options your character might have in terms of interacting with the various forms of law and justice on the server. ••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••••• Introduction The Justice System comprises of every step between police contact and jail or prison, including any trials, appeals, or other court proceedings that may result from a dispute. It also comprises of the steps of dispute resolution and civil law available in non-criminal issues. There are two primary divisions of the system - the Criminal system and the Civil system. The Criminal system is operated by the Executive Branch agencies and overseen by the Judicial Branch. The Civil system is exclusively operated by the Judicial Branch. The Criminal System Detainments When a person is contacted by a peace officer, they may be considered detained if a police officer has reasonable suspicion that a crime has been committed, is being committed, or is about to be committed. A peace officer may detain a person for a reasonable amount of time to conduct a preliminary investigation, the goal of which is either to confirm or dispel his suspicions. During a detainment or investigatory stop, a peace officer may be subject to a cursory pat-down or "frisk" of his person, under Terry v. Ohio, 392 U.S. 1 (1968). A person may also be removed from their vehicle, under Pennsylvania v. Mimms, 434 U.S. 106 (1977), if an officer has reason to believe there is a safety concern present on a traffic stop. This also applies to passengers. Arrests If his suspicions are confirmed, he may have probable cause to conduct an arrest. Alternatively, following a preliminary investigation, a peace officer may choose to release a person from detainment, investigate further, and obtain an arrest warrant if he later determines there is such probable cause. A police officer may ordinarily only conduct an arrest if the crime is committed in his presence. A person may be arrested either custodially or non-custodially. Any offense - including traffic infractions - is eligible for a custodial arrest, see Atwater v. City of Lago Vista, 532 U.S. 318 (2001). On LS:RP, if you would like to pursue a trial, you must request it by informing the officer. Criminal Trials If a person requests a trial, the District Attorney's Office will take over the charges from this point. Your character is entitled to an attorney if they cannot afford one - a Public Defender can be requested on the Judiciary Forums. Alternatively, an officer can request one for you using our private Discord server. If your character can afford an attorney, it is usually best to find one on your own - there is a list available here for anyone who wants to reach out to attorneys, and they sometimes advertise in-game or on the Classifieds or Businesses section. While a character is technically legally allowed to represent themselves (pro se) the Judge may also assign a Public Defender to serve as reserve counsel for such defendants. If a person demonstrates incompetency to defend themselves in court, or an inability to adhere to the Rules of Court, the Judge may relieve the person of their ability to represent themselves. With an attorney, your character will then be able to decide how they would like to plead to the charges. There are many options, however in general if they are requesting a trial your character will be pleading not guilty. Working with an attorney, a person may perform depositions, gather evidence, and is entitled to see all of the evidence held by the state during pre-trial motions. In looking at the evidence, a person may decide to change their plea to guilty or to proceed. There are also other options such as pleading "no contest" or submitting an "Alford plea", which is pleading guilty but maintaining innocence (which preserves the right to a future appeal), per North Carolina v. Alford, 400 U.S. 25 (1970). In a Criminal Action, the burden of proof is upon the state to prove beyond a reasonable doubt that a person has committed the offenses as defined by statute. This standard requires that a fictional "reasonable person" would not doubt the guilt of a person. If there is doubt as to whether the person committed the charged offenses, the person must be found not guilty as the state failed to prove the offense. It is possible for a person to be factually guilty but legally not guilty - this happens when the state fails to meet their burden of proof before the court. From this point, this guide can be helpful in navigating the process of a trial. Criminal Appeals If a character is found Guilty, they have the right to appeal at least once to a higher court to review any questions of law that may arise. On Appeal, a person must have an attorney. An appeal addresses specific types of issues and is not simply an opportunity to re-try the case in full. The Appeals Court will usually hear only matters where there is an accusation of an unfair trial, and the burden of proof will be on the original criminal defendant (and his counsel) to prove. At this stage, there is a presumption of guilt since the person has been adjudicated guilty. Some reasons for an appeal might include: The Judge didn't allow certain evidence (or witnesses) into the trial, which may have affected the outcome. The Judge used his discretion in an abusive manner, and affected the outcome of the trial. There was unlawful evidence introduced to the trial, and the Judge should not have allowed it in. The Judge reached an incorrect ruling, legally-speaking. The Judge reached conclusions of fact that no reasonable person could have reached. The Judge demonstrated bias or unlawful discrimination. An appeal can result in many outcomes: The Appeals Court could uphold the verdict. The Appeals Court could dismiss the appeal, with or without hearing arguments. The Appeals Court could modify the decision of the lower court, such as changing the sentence. The Appeals Court could grant a new trial and remand the case to the lower court for re-trial. The Appeals Court could dismiss the verdict entirely, vacating the person's criminal charges. The Civil System The Civil System comprises of the resolution process for civil wrongs between two private parties. This can be sometimes as simple as an injury, or as complicated as a disputed business transaction or contract. If it doesn't fall within the Criminal System, it probably makes more sense as part of the Civil System. Lawsuits If a character has been harmed in some way - physically, financially, emotionally, etc. - they can file a Civil Action in the Civil Division of the Superior Court. Before proceeding to trial, the Judge will often require that the two parties engage in a conference to discuss the matter and attempt to reach some kind of resolution. This may be formalized as a process of mediation with a neutral third-party such as another attorney. If the dispute cannot be resolved this way, it may proceed to Litigation where the parties will argue before a judge both sides of the case. Ultimately, after each side argues their case, the Judge will decide on the matter and issue a ruling. In a Civil Action, the burden of proof is upon the Plaintiff to prove with a preponderance of the evidence that some entitlement was withheld, a tort was committed, or a contract was breached. A Preponderance of the Evidence, in short, means that the evidence must show that it is more likely that the Plaintiff is correct than the Defendant. Appeals Sometimes, a character may not like the outcome of a civil case and could seek to escalate the matter. A Civil Appeal is much like a Criminal Appeal, since it seeks to address Questions of Law to ensure the court of first instance fairly adjudicated over the matter. Other Civil Actions There are other kinds of Civil Actions, not all of which are used on LS:RP. These include Tax Court, Civil Commitments, and other types of administrative hearings.1 point
